Overview
Microplastics—tiny plastic particles formed as larger plastics break down—have become a widespread environmental and emerging legal concern. Although federal action remains limited, states like California are advancing aggressive measures, including testing protocols and proposed product‑related regulation.
Minnesota has not yet acted, but recent findings of microplastics in state waters and the state’s history of following California suggest future regulation is likely. At the same time, citizen lawsuits under federal environmental laws have already produced multimillion‑dollar settlements and operational changes.
On January 29, 2026, attorneys from Fredrikson’s Environmental Law Group reviewed the science, regulatory trends and litigation risks that may affect Minnesota businesses in the coming years.
