For decades, it was almost a given that businesses could successfully protect their confidential information and employee and customer relationships with a wide range of non-solicitation, non-competition, and other restrictive covenant agreements. Now, these agreements are falling out of favor, and courts (and employees) are reviewing them with increased skepticism.
